Terms of Service

These Terms of Service (“Terms”) govern your use of Pinly (the “App”). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Use of the App

• Eligibility: You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App.
• Personal Use: The App is provided for personal, non-commercial use unless otherwise agreed in writing.
• Compliance: You agree to use the App in compliance with all applicable laws and regulations, including location and notification permissions.

2. Account and Purchases

• No Account Required: Pinly does not require a separate account to use the core features.
• In-App Purchases: Some features (e.g., Pro) may be available via in-app purchases or subscriptions processed through Apple’s StoreKit. All billing, pricing, and refunds are managed by Apple according to App Store policies.
• Entitlements: Upon successful purchase, the App unlocks Pro features on your device(s) associated with your Apple ID.

3. Content and Data

• Your Content: Pins, reminders, notes, tags, and settings you create remain your content. You are responsible for the accuracy and legality of your content.
• Backups: You may choose to back up your data via iCloud. You are responsible for managing your iCloud settings and storage.
• Data Loss: While we take reasonable measures to preserve your data (including local persistence and optional iCloud backup), we cannot guarantee against data loss. We recommend regularly exporting your data if critical.

4. Location and Notifications

• Permissions: The App requires permission to access your location (for geofence reminders) and to send notifications (for timed/location-based alerts). You can change these permissions at any time in your device settings.
• Accuracy: Location services rely on device hardware, operating system, and network conditions. We cannot guarantee precise location accuracy, continuous monitoring, or delivery of notifications in all circumstances.

5. Pro Features and Subscriptions

• Features: Pro may include features such as increased limits, custom radius, quiet hours, export/import, and other enhancements. Features may change over time.
• Pricing: Pricing, availability, and trial offers are subject to change and managed through the App Store.
• Cancellation/Refunds: Manage subscriptions and refund requests via your Apple ID and App Store settings. We do not process payments or refunds directly.

6. Intellectual Property

The App and all associated content, trademarks, designs, and code are owned by us or our licensors and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App solely for personal use.

7. Prohibited Conduct

You agree not to:

• Use the App for unlawful purposes.
• Interfere with or disrupt the operation of the App.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Circumvent or attempt to bypass any security or usage limitations.

8. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that reminders will always trigger, that notifications will always be delivered, or that location services will be accurate. Your use of the App is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim related to the App shall not exceed the amount you paid (if any) for the Pro features during the 12 months prior to the claim.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sweden, without regard to its conflict of laws principles. Any disputes arising from or relating to these Terms or the App shall be resolved in the courts located in Sweden, unless otherwise required by applicable consumer protection laws.

If you are a consumer based in the EU, you also benefit from any mandatory provisions of the law of the country in which you are resident.
